- In Vaud (framework rental agreement) and in Geneva, different rules may apply – if in doubt, ask the conciliation authority.
Legal basis
Art. 257e CO: at most three months' rent; bank account in the tenant's name, the interest belongs to them; release with the consent of both parties, a final payment order or judgment; if the landlord has not asserted a claim through legal channels within one year after the tenancy ends, the tenant can ask the bank to repay the deposit. Art. 267 and 267a CO: handover, normal wear and tear, inspection and notice of defects.
