Notice

Check the notice period and dates in your agreement. For flats the law requires at least 3 months to a locally customary date (Art. 266c CO).

Give notice in writing; everyone who signed the agreement also signs the notice. For a family home, the spouse or registered partner must agree (Art. 266m CO).

Send it by registered mail with a few days to spare: the notice must arrive before the notice period begins.

Leaving early? Propose a solvent replacement tenant who takes over the agreement on the same terms (Art. 264 CO).

Before the handover

Agree a handover date with the landlord.

Clean thoroughly and do the small repairs you are responsible for.

Your own fittings or changes: check what was agreed and whether they may stay.

Get out the move-in report: these defects were already there.

Handover

Walk through the flat together. Read the report carefully and only sign what is correct.

Take dated photos of every room.

Hand over all keys and get a receipt.

Note the meter readings (electricity, water, heating).

You do not pay for normal wear and tear (Art. 267 para. 1 CO). The landlord must report defects immediately (Art. 267a CO).

Afterwards
